Please read this agreement carefully before using the iSMS service. By registering, you agree to be bound by these terms.
All information, material and knowledge shared between both parties are kept confidential. If any party wants a Non-Disclosure Agreement (NDA), both parties will sign off on it.
Thank you for selecting iSMS internet SMS service. This online web application licence agreement is a legal agreement between you and Mobiweb Sdn. Bhd. that describes the terms and conditions applicable to your use of the software. By clicking ACCEPT, you indicate that you have read, understood, and assent to be bound by the terms of this Agreement.
Subject to the terms and conditions of this Agreement, including payment of applicable subscription fees, Developer grants you a personal, limited, non-exclusive, non-transferable licence to electronically access and use the application for which the iSMS credit fee has been paid by you.
The application is licensed, not sold. Developer reserves all rights not expressly granted. The application is protected by copyright, trade secret, and other intellectual property laws. Developer and its licensors own the title, copyright, and other worldwide intellectual property rights in the application and all copies of the application.
No subscription fee is required to access the application. However, purchase of any iSMS credit is only valid if you use a valid credit card or approved payment method.
You must register to use the application and provide true, accurate, current, and complete information as prompted during sign-up. If you provide inaccurate information, Developer may suspend or terminate your account.
In the event that an iSMS account is transferred from one company to another, the former company shall inform iSMS in writing and update all account details accordingly. If the Username is the former company name, a new account shall be opened.
For details about Developer's privacy policies, please refer to our Privacy Policy. iSMS will not monitor, edit, or disclose any personal information about the User or the User's account without prior permission, unless required by law or to protect legitimate interests.
A recipient of a message has the right to know the identity of the sender, and this will be disclosed on request.
iSMS charges are listed at https://www.isms.com.my/rate.php and may be varied from time to time without prior notice. Network service providers' charges may differ and may be varied without prior notice.
iSMS uses secure third-party payment gateways (iPay88 and PayPal). Users have the right to return SMS credits purchased within 7 days. Credits purchased using a credit card will expire within 12 months of the date of purchase.
You agree not to use iSMS to send or post any message that is unlawful, harassing, scam, fraud, defamatory, abusive, threatening, harmful, obscene, sexually orientated, racially offensive, profane, or violates any applicable law. iSMS will terminate your account if illegal content is found — payment is not refundable.
Advertising Content SMS: The distribution of advertising to mobile subscribers requires particular care. You shall avoid sending unsolicited messages ("Spamming"). SMS shall only be transmitted between 7:00 AM to 10:00 PM. Messages shall contain the name of the party providing the content.
iSMS makes no warranties, representations, statements or guarantees (whether express, implied in law, or residual) regarding the website, the information contained on the website, your personal information, or material and information transmitted over our system.
EXCEPT AS EXPRESSLY PROVIDED HEREIN, THE SOFTWARE, SERVICES, AND ANY CONTENT ACCESSIBLE THROUGH THE SOFTWARE ARE PROVIDED "AS-IS" AND, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEVELOPER, ITS AFFILIATES, LICENSORS, THIRD-PARTY CONTENT OR SERVICE PROVIDERS, DEALERS AND SUPPLIERS DISCLAIM ALL GUARANTEES AND WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, REGARDING THE SOFTWARE, SERVICES, CONTENT, AND RELATED MATERIALS, INCLUDING ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, TITLE, MERCHANTABILITY, AND NON-INFRINGEMENT.
iSMS shall not be responsible for and disclaims all liability for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you or any third party as a result of your access and use of the website or iSMS services.
THE ENTIRE CUMULATIVE LIABILITY OF DEVELOPER SHALL BE LIMITED TO THE AMOUNT PAID BY YOU FOR THE SOFTWARE, UNLESS OTHERWISE SEPARATELY AGREED BY DEVELOPER IN WRITING.
Your rights under this Agreement may be terminated or suspended by Developer immediately and without notice if you or any of your authorised users fail to comply with any term or condition of this Agreement. Upon termination you must immediately cease using the application and services.
14.1 Entire Agreement: These terms and conditions constitute the sole record of the agreement between you and iSMS. Unless otherwise specifically stated, these terms supersede and replace all prior commitments, undertakings or representations.
14.2 Alteration and Amendments: iSMS may at any time modify any relevant terms and conditions, policies, or notices. By continuing to use the website, you accept the current version of the terms.
14.3 Conflict: Where conflict appears between these terms and any other relevant terms and conditions, the more specific terms shall prevail.
14.7 The Services: The delivery and receiving of SMS messages is largely dependent on the effective functioning of network operators' cellular networks, network coverage, and the SMS recipient's mobile handset. iSMS cannot guarantee the availability of the service or delivery/receiving of SMS messages. iSMS shall make all reasonable endeavours to ensure continued use of the service.
Network operators may modify, enhance, develop, or discontinue components of their services at any time without prior notice, in which event iSMS shall be entitled to modify, enhance, develop, or discontinue its services to Users without notice.
14.9 Anti-Spam Policy: iSMS strictly forbids spamming to mobile phone users. We have software filters to block spam messages. If you receive unsolicited messages, please report to [email protected] with the message content, delivery time, and sender name/number.
